The challenge
An individual was owed over £10,000 by their former employee following an Employment Tribunal award.
Our solution
A Notice of Enforcement was sent and two days after the compliance period ended, an Enforcement Agent attended the defendant’s address and discovered it to be a small convenience store. The director claimed they had received no prior notice of the debt and would therefore not pay. The Enforcement Agent explained that a Notice of Enforcement had been sent just two weeks previously and before this the Employment Tribunal hearing and award would also have been communicated to them prior to Marston’s involvement.
It was explained that if they did not pay then we would have to execute the writ by ay of the removal of assets from the address.
The impact
The director agreed to pay and cleared the balance via a bank transfer.
